Legal Ethics and Marketing

In the past thirty years, lawyer marketing has gone from being “unprofessional conduct” to an essential aspect of private practice. Law is now regarded as a business and the market for legal services is competitive.

Topics for discussion include:

  • Advertising: What are the current restrictions? What is permissible and what is not?

  • Confidentiality: Potential clients want to know your “track record”. To what extent does this conflict with your duty of client confidentiality?

  • Referrals: What are the ethical issues? Can you pay to receive referrals, or receive payment for making them? What disclosures must be made, when and how?

  • Social Media: What are the ethical risks? What precautions should be taken?
